Anonymity of defendants 

  • Anonymity of accused – Rape s. 8 Criminal Law (Rape) Act 1981

  • S.93 Children Act 2001 in relation to restrictions of any reporting where children are concerned

  • In relation to the child accused, while s.93 Children Act 2001 allows for the anonymity of the child in proceedings which are complete prior to the child reaching the age of 18, anonymity is lost if the prosecution straddles the accused’s 18th birthday. Where procceedings have been completed before his or her 18th birthday, the courts have indicated that it is clear that the protection conferred  on the defendant by s.93; continues for life. ( McDermott J, [2018] IEHC 120 para. 43)
