Case Law
As much of the legislation regarding vulnerable witnesses, complainants and defendants is either older or quite confusing, and since the accompanying guidance is minimal, the courts provide great assistance through previous decisions which interpret the legislation. Case law also shows how the courts can rely on their own inherent jurisdiction to facilitate the vulnerable in the criminal justice system. International case law, particularly from the neighbouring jurisdiction of England and Wales is helpful as it can flag how to address issues that may arise.
