Donnelly v Ireland 1998 Supreme Court - one of the most significant cases involving vulnerable witnesses - the right to cross examine was analysed in a challenge to the use of video link. The Supreme Court acknowledged the stress of a court room setting for a child and set out that there is no constitutional right to physically confront a witness. The Court also outlined that once the right to cross examination is maintained then how the cross examination is carried out can be modified. It also said that if there is a hierarchy of rights, (but wasn't confirming that there was) the defendant's right to a fair trial was the priority.
